About Manoj Soni:

  • Manoj Soni is currently a member of the Union Public Service Commission (UPSC). Before being appointed as the head of UPSC, Manoj Soni served as the Vice-Chancellor for three terms.
  • This includes two consecutive terms as Vice Chancellor of Dr. Babasaheb Ambedkar Open University – six years (2009-2015) and one term (2005-2008) as Vice-Chancellor of Maharaja Sayajirao University of Baroda (MSU Baroda).
  • At the age of 40, Dr. Soni was the youngest ever Vice Chancellor of India and MSU when he took over at the Maharaja Sayajirao University of Baroda.

Appointment of the Chairman and other members of the Union Public Service Commission

 Article 316: Appointment and term of office of members : The Hindu Analysis

  • The Chairperson and other members of the Public Service Commission shall be appointed by the President in the case of a Union Commission or Joint Commission and, in the case of a State Commission, by the Governor of the State.

Term of office : The Hindu Analysis

  • A member of a Public Service Commission, for a term of six years from the date on which he enters upon his office, or until he attains the age of sixty-five years in the case of a Union Commission and [sixty-two years] in the case of a State Commission or a Joint Commission. Whichever is earlier, shall hold his office.

Reappointment : The Hindu Analysis

  • A person who holds office as a member of the Public Service Commission shall not be eligible for reappointment to that post on the expiry of his term of office.
  • The Chairman of the Union Public Service Commission shall not be eligible for any further employment under the Government of India or the Government of any State.
  • A member other than the Chairman of the Union Public Service Commission shall be eligible to be appointed as the Chairman of the Union Public Service Commission or as the Chairman of a State Public Service Commission, but under the Government of India or the Government of any other State will not be eligible for employment.
  • Also, the Chairman of a State Public Service Commission shall be eligible to be appointed as the Chairman or any other member of the Union Public Service Commission or as the Chairman of any other State Public Service Commission, but not under the control of the Government of India or the Government of any State shall not be eligible for any other employment under.

Article 317: Removal and suspension of a member of the Public Service Commission –

  • The Chairman or any other member of the Public Service Commission shall be removed from his office by the order of the President merely on the ground of misconduct. An inquiry into misconduct against the Chairman or any other member of the Commission shall be made by the Supreme Court in accordance with the procedure prescribed in this behalf under Article 145 of the Constitution.
  • On being found guilty in the inquiry, the court shall, in its report to the President, recommend the removal of the member or commission concerned.

In addition, the President can remove the Chairman or any other member of the Public Service Commission from office in the following situations – if the Chairman or the Member:

  • is adjudged insolvent, or
  • Works during his term of office in any paid employment outside the duties of his office, or
  • Is in the opinion of the President unfit to continue in office by reason of infirmity of mind or body.

Guilty of misconduct : The Hindu Analysis

  • If the Chairman or any other member of the Public Service Commission, as a member of a company incorporated and jointly with the other members of the company, otherwise than by contract or agreement entered into by or on behalf of the Government of India or a State Government, or is done, is in any way concerned or interested or becomes or takes part in the profit thereof or any benefit or achievement arising out of it, he shall be deemed to be guilty of misconduct.
